Health & Safety at Work Act 1974 requires you to have a Duty of Care to your employees and to ensure, so far as is reasonably practicable, the health and safety of all employees whilst at work. You must minimise the risks your employees face with work related driving activities and you also have a responsibility to ensure that others are not put at risk by your employees.
The Management of Health and Safety at Work Regulations 1999 requires employers to carry out an assessment of the risks to the health and safety of its employees, or themselves, whilst they are at work and to other people who may be affected by their work activities. This includes any driving activity on the road. The regulations state that risk assessments for all tasks carried out by employees in the course of their work, including driving, are mandatory and that they must be reviewed periodically to ensure that it remains valid. So assess drivers competence first then provide training if and where it is needed.
